Sub: Filling up of Vacancies is allowed only by adhering to the laid down procedures and specific Recruitment Rules even under delegated powers in Rule-124 of R-I-reiteration of instructions thereof.
Ref: Railway Board’s letter E(NG)I-95/TR/16 dated 20.12.1995 and E(NG)I/2006/TR/18 dated 25.09.2007 (RBE No. 121/2007).
An instance has come to the notice that in one of the Railways direct recruitment quota vacancies in Accounts Department were filled up without the agency of Railway Recruitment Board from amongst existing serving staff of disparate categories using the delegated powers under Rule 124 of the Indian Railways Establishment Code, Volume-I (R-I).
In this regard, attention is invited to the instructions contained in Para 171 of IREM-I wherein detailed procedure is laid down to be adopted for filling up of vacancies of Accounts Department on promotion as well as recruitment and instructions issued vide RBE No. 121/2007, prohibiting change of select categories of Commercial and Accounts Departments.
Attention is also drawn to the fact that the powers to frame rules under Rule-124 in R-I with respect to Group-C & D posts are subject to the condition that such rules are not inconsistent with the rules made by the President or the Ministry of Railways.
Therefore, it is hereby reiterated that the vacancies must be filled as per the Recruitment Rules and procedures laid down by the Railway Board for this purpose.

विषय: आर-आई के नियम-124 के अंतर्गत प्रत्यायोजित शक्तियों के अधीन भी रिक्त पदों की भर्ती केवल निर्धारित प्रक्रियाओं और विशिष्ट भर्ती नियमों का पालन करके ही की जानी है – इस संबंध में निर्देशों का पुन: प्रेषण।
संदर्भ: रेलवे बोर्ड का पत्र संख्या ई(एनजी)आई-95/टीआर/16 दिनांक 20.12.1995 और ई(एनजी)आई/2006/टीआर/18 दिनांक 25.09.2007 (आरबीई संख्या 121/2007)।
ध्यान में आया है कि एक रेलवे में, लेखा विभाग में प्रत्यक्ष भर्ती कोटा के रिक्त पदों को भारतीय रेलवे स्थापना संहिता, भाग-I (आर-आई) के नियम 124 के अंतर्गत प्रत्यायोजित शक्तियों का उपयोग करते हुए, रेलवे भर्ती बोर्ड की एजेंसी के बिना, विभिन्न श्रेणियों के मौजूदा कार्यरत कर्मचारियों में से भर दिया गया था।
इस संबंध में, आईआरईएम-I के पैरा 171 में निहित निर्देशों का ध्यान आकृष्ट किया जाता है, जिसमें लेखा विभाग के रिक्त पदों को पदोन्नति के साथ-साथ भर्ती द्वारा भरने के लिए अपनाई जाने वाली विस्तृत प्रक्रिया निर्धारित की गई है और आरबीई संख्या 121/2007 द्वारा जारी निर्देश, जो वाणिज्यिक और लेखा विभागों की चयन श्रेणियों में परिवर्तन पर प्रतिबंध लगाते हैं।
इस तथ्य की ओर भी ध्यान दिलाया जाता है कि समूह-सी और डी के पदों के संबंध में आर-आई के नियम-124 के अंतर्गत नियम बनाने की शक्तियाँ इस शर्त के अधीन हैं कि ऐसे नियम राष्ट्रपति या रेल मंत्रालय द्वारा बनाए गए नियमों के असंगत नहीं हैं।
अतः, यहां यह पुन: दोहराया जाता है कि रिक्त पदों को भरना रेलवे बोर्ड द्वारा इस उद्देश्य के लिए निर्धारित भर्ती नियमों और प्रक्रियाओं के अनुसार ही होना चाहिए।
