Sub: Provision for imposition of penalty under the Indian Railway Station Rules, 2012 and amendment through the Jan Vishwas (Amendment of Provisions) Act, 2026 – Gazette Notification No. GSR 758(E) dt. 25.08.2026.
1. The provision for imposition of penalty under the Indian Railway Station Rules, 2012 and amendment through the Jan Vishwas (Amendment of Provisions) Act, 2026 have been notified in the Extraordinary Gazette of India, Part II, Section 3, Sub-Section (i) vide Gazette Notification No. GSR 758(E) dt. 25.08.2026. A copy of the notification is enclosed.
2. In view of the provisions available in the above mentioned rules, the following action should be taken by the Zonal Railways:
(i) Wide Publicity should be given to the rules through advertisements in various newspapers (including vernacular ones), pasting of posters at all railway stations, putting up of notices inside the coaches, announcement through public address system at stations, advertisement over Radio/TV etc.
(ii) Zonal Railways should frame the procedure for guiding the authorized officials keeping in view the local conditions and accordingly nominated officials for the purpose.
3. Realisation of penalty amount would be chargeable to the Head Abstract Z- Sundry Other Earnings, Z-652- Other Sundry Receipts as per Board’s letter No. 2012/ACII/45/15 Dated 12.12.2012.
4. PCCMs should indicate the amount of penalty collected on this account in the MCDO to Railway Board.
5. This issues with the concurrence of Finance and Accounts Directorates of Ministry of Railways.

विषयः भारतीय रेलवे स्टेशन नियम, 2012 के तहत जुर्माना लगाने का प्रावधान और जन विश्वास (प्रावधानों का संशोधन) अधिनियम, 2026 के माध्यम से संशोधन दिनांक 25.08.2026 की राजपत्र अधिसूचना संख्या सा.का.नि. 758(अ.)
- भारतीय रेल स्टेशन नियम, 2012 के तहत जुर्माना लगाने का प्रावधान और जन विश्वास (उपबंधों का संशोधन) अधिनियम, 2026 के माध्यम से संशोधन को भारत का असाधारण राजपत्र, भाग-2, धारा 3, उप-धारा (i) के दिनांक 25.08.2026 की राजपत्र अधिसूचना संख्या सा.का.नि. 758 (अ.) के तहत अधिसूचित किया गया है। अधिसूचना की एक प्रति संलग्न है।
- ऊपर उल्लिखित नियमों में उपलब्ध उपबंधों को देखते हुए क्षेत्रीय रेलों द्वारा निम्नलिखित कार्रवाई की जाएः
(i) इन नियमों को विभिन्न समाचार पत्रों (देशी भाषाओं के समाचार-पत्रों सहित), सभी रेलवे स्टेशनों पर पोस्टर चिपकाकर, सवारी डिब्बों के अंदर सूचना लगाकर, स्टेशनों पर जन उद्घोषणा करके, रेडियो/टीवी पर विज्ञापन आदि के माध्यम से इनका व्यापक प्रचार किया जाए। (ii) क्षेत्रीय रेलें, स्थानीय स्थितियों को ध्यान में रखते हुए प्राधिकृत अधिकारियों के मार्गदर्शन के लिए प्रक्रिया निर्धारित करें और तदनुसार इस प्रयोजनार्थ अधिकारियों को नामित करें। - बोर्ड के दिनांक 12.12.2012 के पत्र सं. 2012/ एसी /45/15 के अनुसार वसूल की गई जुर्माने की राशि शीर्ष सार जेड-अन्य फुटकर आमदनी, जेड-652-अन्य फुटकर प्राप्तियां को प्रभार्य होंगी।
- प्रधान मुख्य वाणिज्य प्रबंधक वसूल की गई जुर्माने की राशि को एमसीडीओ में दर्शाते हुए रेलवे बोर्ड को सूचित करें।
- इसे रेल मंत्रालय के वित्त और लेखा निदेशालयों की सहमति से जारी किया जा रहा है।

सा.का.नि. 758(अ).—केंद्रीय सरकार, रेल अधिनियम, 1989 (1989 का 24) की धारा 60 की उपधारा (2) के खंड (छ) और उपधारा (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय रेल (रेल परिसर में स्वच्छता को प्रभावित करने वाले क्रियाकलाप हेतु शास्तियां) नियम, 2012 में संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्ः-
- संक्षिप्त नाम और प्रारंभ :- (1) इन नियमों का संक्षिप्त नाम भारतीय रेल (रेल परिसर में स्वच्छता को प्रभावित करने वाले क्रियाकलाप हेतु शास्तियां) संशोधन नियम, 2026 है। (2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।
- भारतीय रेल (रेल परिसर में स्वच्छता को प्रभावित करने वाले क्रियाकलाप हेतु शास्तियां) नियम, 2012 के, नियम 4 में “उसे जुर्माने से दंडित किया जाएगा जो पांच सौ रुपए से अनधिक नहीं होगा” शब्दों के स्थान पर “वह एक हजार रुपए की शास्ति का दायी होगा, और शास्ति का संदाय न किए जाने की स्थिति में, ऐसा न करने में असफल रहने वाले व्यक्ति को अधिकारिता प्राप्त सक्षम न्यायालय के समक्ष पेश किया जाएगा, जो जुर्माना अधिरोपित कर सकेगा, जो कि दो हजार रुपए तक का हो सकेगा।” शब्द रखे जाएंगे।

NOTIFICATION
New Delhi, the 24th August, 2026
G. S. R. 758(E).—In exercise of the powers conferred by clause (g) of sub-section (2) and sub-section (3) of section 60 of the Railways Act, 1989 (24 of 1989), the Central Government hereby makes the following rules, to amend the Indian Railways (Penalties for activities affecting cleanliness at railway premises) Rules, 2012, namely:-
- Short title and Commencement.—(1) These rules may be called the Indian Railways (Penalties for activities affecting cleanliness at railway premises) Amendment Rules, 2026. (2) They shall come into force on the date of their publication in the Official Gazette.
- In the Indian Railways (Penalties for activities affecting cleanliness at railway premises) Rules, 2012, in rule 4, for the words “punished with a fine which shall not exceed five hundred rupees”, the words “liable to penalty of one thousand rupees, and in the event of non-payment of the penalty, the person so failing shall be produced before a competent court having jurisdiction which may impose a fine which may extend to two thousand rupees” shall be substituted.
