Sub:- Posting of Husband and Wife at the same place – Instructions in respect of Non-gazetted Railway employees.
The extant instructions regarding posting of husband and wife at the same station in respect of Non-gazetted Railway employees are contained in the Ministry of Railways letter No. E(NG)I1/71/TR/14 dated 01.10.71, No. E(NG)1-86/TR/14 dated 06.01.1988 and No. E(NG)I-96/TR/28 dated 6.12.95. The instructions regarding posting of husband and wife were modified & circulated to Railways vide this Ministry’s letter No. E(NG)1/97/TR/28 dated 05.11.1997 and letter of even number dated 02.02.2010, consequent upon acceptance of recommendations of 5th & 6th CPC respectively. However, it has been brought to the notice of this office that there is some confusion about certain provisions of the instructions and applicability of the same in various situations. Accordingly, the matter has been considered by this Ministry and consolidated instructions for posting of husband and wife working in non-gazetted cadres in Railways are being issued in supersession of Railways Board’s letters dated 02.02.2010, ibid.
2. In the context of the need to make concerted efforts to increase representation of women in Central Government jobs, the Government vide DoP&T’s O. M. No.28034/9/2009-Estt(A) dated 30.09.2009 has decided that where both spouses are in the same Central Service or working in the same department, and if posts at an appropriate level are available, they may mandatorily be posted at the same station, provided that no administrative problems are expected to arise as a consequence.
3. Further, on the basis of the 6th CPC Recommendations, Government Servants have already been allowed the facility of Child Care Leave which is admissible till the children attain 18 years of age. On similar lines, provisions of Railway Board’s letter dated 05.11.1997 have been amended and the consolidated guidelines will now be as under:
(i) where both the spouses are railway employees and belong to the same seniority unit:
The husband and wife, if working in the same department and if the required level of post is available, should invariably be posted together, ensuring that one of them does not work as subordinate to the other, in order to enable them to lead a normal family life and look after the welfare of their children especially till the children attain 18 years of age.
(ii) where both the spouses are railway servants but belong to different seniority units
Efforts may be made to post both the railway servants at the station where posts at appropriate level exist in the respective seniority units failing which requests for change of the category may be considered sympathetically, keeping in view all other relevant rules in the matter.
(iii) where one of the spouses is a railway servant and the other belongs to All India Service or another central Service.
The Railway servant should be posted at station/place in the Railway/Division/PU in whose territorial jurisdiction the place/state of posting of his/her spouse falls, or as close to it as possible if there is no Railway organisation/post at the place/state of posting of the spouse.
(iv) where one of the spouses is a railway servant and the other belongs to a state service:
The Railway servant should be posted at the station/place in the Railway/Division/PU in whose territorial jurisdiction the place/state of posting of his/her spouse falls. If it is not possible, if a request from the railway servant to the controlling Authority of the spouse for his/her posting at the place of posting of the railway servant is received, the same may be forwarded to the concerned authority for sympathetic consideration.
(v) whereone of the spouses is a railway servant and the other is working in a central/state Public Sector Undertaking
The railway servant may apply to the controlling Authority for a posting at the place of posting of his/her spouse which may be considered favourably by the competent authority. If no post is available for posting of the railway servant at the place of posting of the spouse he/she may be posted to a place closer to the place of posting of the spouse. If this also is not possible, an application from the railway servant for posting of the spouse who is working in the Central/State Public Sector Undertaking may be forwarded to the controlling authority of the spouse for his/her posting at or near the place of posting of the railway servant.
4. The guidelines given above are only illustrative and not exhaustive. The Ministry of Railways desire that in all other cases the controlling authority of the railway servants should consider requests from non-gazetted railway servants for transfer to the place of posting of their spouses with utmost sympathy. Where only wife is a Railway Servant, above concessions shall be applicable to the Railway Servant.
5. Complaints are sometimes received that even if posts are available at the station of posting of the spouse, the administrative authorities do not accommodate the employees citing administrative reasons. In all such cases, the cadre controlling authority should strive to post the employee at the station of spouse and in case of inability to do so, specific reasons, therefore, may be communicated to the employee.
6. Although, normal channels of representations/complaints redressal mechanism exists, added safeguards to prevent non-compliance may be provided by ensuring that the complaints against non-adherence to the instructions are decided by authorities at least one level above the authorities which took the original decision when they are below the SAG level/Head of PUs. All such representations should be considered and disposed of in a time bound manner.
7. While all efforts as stated in the foregoing paragraphs may be made to post the husband and wife at the same station, instructions issued by the Board from time to time in regard to request transfer/change of category should be followed in all such cases. A separate register maybe maintained at each Divisional and Zonal Headquarters of the Railways for registering requests for transfers from railway servants for posting at the place of posting of their spouses, which may be reviewed from time to time.
8. The above instructions shall be applicable for posting of Husband and Wife at same station in respect of Non-Gazetted Railway Servants. The posting in case of Gazetted officers shall continue to be governed by Railway Board’s letter No. E(O)III/2014/PL/05 dt.31.08.2015.
9. Past case decided in terms of Board’s earlier letter dated 02.02.2010 which may not be in conformity with the above modified instructions need not be reopened.

विषयः- पति और पत्नी की एक ही स्थान पर तैनाती अराजपत्रित रेल कर्मचारियों के संबंध में अनुदेश।
अराजपत्रित रेल कर्मचारियों के संबंध में पति और पत्नी की एक ही स्टेशन पर तैनाती के बारे में मौजूदा अनुदेश रेल मंत्रालय के दिनांक 01.10.71 के पत्र सं. ई (एनजी) 11/71/टीआर/14, दिनांक 06.01.1988 के पत्र सं. ई (एनजी) I-86/टीआर/14 और दिनांक 6.12.95 का पत्र सं.ई (एनजी) 1-96/टीआर/28 में उल्लेखित हैं। पांचवें और छठे केंद्रीय वेतन आयोग की सिफारिशों की स्वीकृति के परिणामस्वरूप, पति और पत्नी की तैनाती से संबंधित अनुदेशों में आशोधन किया गया और उन्हें दिनांक 05.11.1997 के पत्र सं.ई (एनजी) 1/97/टीआर/28 और दिनांक 02.02.2010 के समसंख्यक पत्र के तहत रेलों को परिपत्रित किया गया। बहरहाल, इस कार्यालय के ध्यान में यह बात आई है कि अनुदेशों के कुछ प्रावधान और विभिन्न स्थितियों में उनके लागू होने को लेकर कुछ असमंजस है। तदनुसार, मंत्रालय ने इस मामले पर विचार किया है और रेलों में अराजपत्रित संवर्ग में कार्यरत पति और पत्नी की तैनाती से संबंधित समेकित अनुदेश रेलवे बोर्ड के दिनांक 02.02.2010 के उपरोक्त उल्लिखित पत्रों के अधिक्रमण में जारी किया जा रहे हैं।
2. केन्द्रीय सरकार की नौकरियों में महिलाओं के प्रतिनिधित्व को बढ़ाने के लिए ठोस प्रयास करने की आवश्यकता के संदर्भ में, सरकार ने कार्मिक एवं प्रशिक्षण विभाग के दिनांक 30.09.2009 के कार्यालय ज्ञापन सं. 28034/9/2009-ईएसटीटी (ए) के माध्यम से यह विनिश्चय किया है कि जहां दोनों पति-पत्नी एक ही केन्द्रीय सेवा में हो या एक ही विभाग में काम कर रहे हो, और यदि उचित स्तर पर पद उपलब्ध हो, तो उन्हें अनिवार्य रूप से एक ही स्टेशन पर तैनात किया जाए, बशर्ते इसके परिणामस्वरूप कोई प्रशासनिक समस्या उत्पन्न होने की संभावना न हो।
3. इसके अलावा, छठे केंद्रीय वेतन आयोग के सिफारिशों के आधार पर, सरकारी कर्मचारियों को पहले से ही शिशु देखभाल छुट्टी की सुविधा दी गई है जो बच्चों के 18 वर्ष की आयु प्राप्त करने तक अनुमेय है। इस प्रकार, रेलवे बोर्ड के दिनांक 05.11.1997 के पत्र के प्रावधानों में आशोधन किया गया है और अब समेकित दिशानिर्देश निम्नानुसार होंगे:
(i) जहां दोनों पति-पत्नी रेल कर्मचारी हो और एक ही वरीयता इकाई से संबंधित होः
पति और पत्नी, यदि एक ही विभाग में काम कर रहे हो और यदि पद का आवश्यक स्तर उपलब्ध हो, तो उन्हें अनिवार्य रूप से एक साथ तैनात किया जाना चाहिए, यह सुनिश्चित करते हुए कि उनमें से कोई भी एक दूसरे के अधीनस्थ के रूप में काम नहीं करते हो, ताकि वे एक स्वाभाविक पारिवारिक जीवन व्यतीत कर सकें और अपने बच्चों का हितों को ध्यान में रख सकें, विशेष रूप से तब तक जब तक कि बच्चे 18 वर्ष की आयु के नहीं हो जाते।
(ii) जहां दोनों पति-पत्नी रेल कर्मचारी हैं परन्तु अलग-अलग वरिष्ठता इकाइयों से संबंध रखते हैं
दोनों रेल कर्मचारियों को ऐसे स्टेशन पर तैनात करने के प्रयास किए जाएं जहां उनकी वरिष्ठता इकाइयों में उचित स्तर पर पद मौजूद हों, ऐसा न होने पर, इस मामले में अन्य सभी संगत नियमों को ध्यान में रखते हुए श्रेणी में परिवर्तन के अनुरोध पर सहानुभूतिपूर्वक विचार किया जा सकता है।
(iii) जहां पति/पत्नी में से एक रेल कर्मचारी है और दूसरा अखिल भारतीय सेवा या दूसरी केंद्रीय सेवा से संबंध रखता है।
रेल कर्मचारी को उस रेल/मंडल/उत्पादन इकाई में ऐसे स्टेशन/स्थान पर तैनात किया जाना चाहिए जिसके क्षेत्रीय अधिकार-क्षेत्र में उसके पति अथवा पत्नी की तैनाती का स्थान/राज्य पड़ता हो अथवा यदि पति/पत्नी की तैनाती के स्थान/राज्य में कोई रेल संगठन / पद न हो तो उनकी तैनाती जितना संभव हो, उसके नज़दीक होनी चाहिए।
(iv) जहां पति/पत्नी में से कोई एक रेल कर्मचारी हो और दूसरा राज्य सेवा में हो।
रेल कर्मचारी को उस रेल/मंडल/उत्पादन इकाई में ऐसे स्टेशन/स्थान पर तैनात किया जाना चाहिए जिसके क्षेत्रीय अधिकार-क्षेत्र में उसके पति/पत्नी की तैनाती का स्थान/राज्य पड़ता हो। यदि ऐसा होना संभव नहीं हो, तो पति/पत्नी के नियंत्रण अधिकारी के पास रेल कर्मचारी द्वारा उसके पति/पत्नी की तैनाती रेल कर्मचारी की तैनाती के स्थान पर किए जाने के लिए अनुरोध आता है तो उस पर सहानुभूतिपूर्वक विचार के लिए संबंधित प्राधिकारी को अग्रेषित किया जाए।
(v) जहां पति/पत्नी में से कोई एक रेल कर्मचारी हो और दूसरा केंद्र/राज्य/सार्वजनिक क्षेत्र उपक्रम में कार्यरत हो।
रेल कर्मचारी अपने नियंत्रण अधिकारी को पति/पत्नी के तैनाती के स्थान पर तैनाती के लिए आवेदन कर सकता है, जिस पर सक्षम प्राधिकारी द्वारा सकारात्मक रूप से विचार किया जा सकता है। यदि पति/पत्नी के तैनाती के स्थान पर रेल कर्मचारी की तैनाती के लिए कोई पद उपलब्ध नहीं है, तो उसकी तैनाती पति/पत्नी की तैनाती स्थान के नज़दीक की जाए। यदि यह भी संभव न हो तो, रेल कर्मचारी के पति/पत्नी जो केंद्र/राज्य/सार्वजनिक क्षेत्र उपक्रम में कार्यरत है, रेल कर्मचारी की तैनाती स्थान या उसके नज़दीक किए जाने के लिए रेल कर्मचारी द्वारा किए गए आवेदन को पति/पत्नी के नियंत्रण अधिकारी को अग्रेषित किया जाए।
4. उपरोक्त दिशानिर्देश केवल उदाहरण के रूप में हैं और संपूर्ण नहीं हैं। रेल मंत्रालय ने वांछा की है कि अन्य सभी मामलों में, रेल कर्मचारियों के नियंत्रण प्राधिकारी को अराजपत्रित रेल कर्मचारियों से उनके जीवनसाथी के पदस्थापन के स्थान पर स्थानांतरण के अनुरोधों पर पूरी सहानुभूति के साथ विचार करें। उपरोक्त रियायतें उस रेल कर्मचारी पर लागू होंगी, जहां केवल पत्नी ही रेल कर्मचारी है।
5. कभी-कभी ऐसी शिकायतें भी प्राप्त हुई हैं कि पति-पत्नी के पदस्थापन वाले स्टेशन पर पद उपलब्ध होने पर भी, प्रशासनिक प्राधिकारी प्रशासनिक कारणों का हवाला देते हुए कर्मचारियों को वहां तैनात नहीं किया जाता है। ऐसे सभी मामलों में, कैडर नियंत्रण प्राधिकारी को कर्मचारी को पति-पत्नी के पदस्थापन वाले स्टेशन पर तैनात करने का प्रयास करना चाहिए और यदि ऐसा करना संभव न हो, तो, कर्मचारी को इसके विशिष्ट कारणों से अवगत कराया जाए।
6. यद्यपि, अभ्यावेदन/शिकायतों के निवारण तंत्र के सामान्य चैनल मौजूद हैं, गैर-अनुपालन को रोकने के लिए शिकायतों के संबंध में जोड़े गए संरक्षोपाय, यह सुनिश्चित करके प्रदान किए जाए कि अनुदेशों के गैर-अनुपालन के संबंध में शिकायतों पर निर्णय, मूल निर्णय लेने वाले अधिकारी जब वे वरिष्ठ प्रशासनिक ग्रेड/उत्पादन इकाइयों के शीर्ष अधिकारी से निचले स्तर पर थे, से कम से कम एक स्तर ऊंचे अधिकारी द्वारा लिया जाए। इस प्रकार के सभी अभ्यावेदनों पर विचार किया जाना चाहिए और समयबद्ध तरीके से इनका निपटान किया जाए।
7. जबकि पूर्ववर्ती पैराग्राफ में बताए गए सभी प्रयास पति और पत्नी को एक ही स्टेशन पर तैनात करने के लिए किए जाए, ऐसे सभी मामलों में बोर्ड द्वारा स्थानांतरण/कोटि परिवर्तन के अनुरोध के संबंध में समय-समय पर जारी किए गए अनुदेशों का पालन किया जाना चाहिए। रेल कर्मचारियों के पति/पत्नी की एक स्थान पर तैनाती के लिए अनुरोधों को दर्ज करने के लिए रेलवे के प्रत्येक मंडल और क्षेत्रीय मुख्यालय में एक अलग रजिस्टर बनाया जाए, जिसकी समय-समय पर समीक्षा की जाए।
8. उपरोक्त अनुदेश अराजपत्रित रेल कर्मचारियों के संबंध में पति और पत्नी की एक ही स्टेशन पर तैनाती के लिए लागू होंगे। राजपत्रित अधिकारियों की तैनाती के मामले में रेलवे बोर्ड के दिनांक 31.08.2015 के पत्र संख्या ई (ओ) III/2014/पीएल/05 द्वारा शासित होती रहेगी।
9. बोर्ड के दिनांक 02.02.2010 के पूर्व पत्र के संदर्भ में तय किए गए पिछले मामले, जो उपरोक्त आशोधित अनुदेशों के अनुरूप नहीं हो सकते है, उन्हें पुनः खोलने की आवश्यकता नहीं है। कृपया पावती दें।
