Disposal of NSP Weapon – An advisory for the Veterans: Entitlement as per Army Orders, Procedure of Disposals, Application Forms & Certificates.

DISPOSAL OF NSP WEAPON
AN ADVISORY FOR THE VETERANS

1. A large number of Veterans are in possession of NSP weapons. Disposal of these weapons is a matter of common concern. The Veterans in possession of weapons must familiarize themselves with the Arms Act, and any further amendments (Arms Act of 1959 read in conjunction with Arms (Amendment) Act 2019), and the relevant Army Orders (SAO 4/5/2006, AOQ227/75, SAOQ6/S/81).

2. Entitled Personnel as per Army Order.

(a) Serving Army Officers – All Weapons
(b) Retired Army Officers – All Weapons less “Prohibited Bore”
(c) JCOs – Carbine .30, Rif 30BA & SBBL
(d) Civilian Gazetted Officers – Pistol/ Revolver .32 &
(Serving Class I only) -12 Bore SBBL/DBBL

3. The options available for disposal of NSP Weapon are as under:

(a) Transfer of weapon to Another’ Entitled Personnel- Officer/JCO (Serving / Retired).
(b) Return the Weapon to the Ordnance Depot.
(c) On Demise of a NSP Weapon Holder, the legal heirs may apply for retention as family heirloom on sentimental reasons.

4. Procedure. The Disposal of the NSP Weapon can be carried out only after the approval of the Standing Allotment Committee (STC). The documents required to be submitted are as per the link given below:

(a) Transfer of weapon to Another Entitled Personnel.

(i) Application from the Transferor – Appendix ‘A’
(ii) Application from the Transferee – Appendix ‘B’
(iii) Certificate from the Transferee that “I am not in possession of any NSP weapon allotted to me through Ordnance or transferred by any other entitled person”– Appendix ‘C’
(iv) Photocopy of the Issue Voucher of the Weapon issued by the Ordnance Depot.
(v) In case of loss of Issue Voucher, an Affidavit as per Appendix ‘F’
(vi) Legible copy of the Valid Arms License of the Transferor and the Transferee (If retired).
(vii) If Arms License is not renewed, an Affidavit on Rs 10/- Non Judicial Stamp Paper attested by Notary, sample at Appendix ‘G’

(b) Return the Weapon to Ordnance Depot.
(i) Application from the Weapon Holder–Appendix ‘D’.
(ii) Photocopy of the Issue Voucher of the Weapon issued by the Ordnance Depot.
(iii) In case of loss of Issue Voucher, an Affidavit as per Appendix ‘F’.
(iv) Legible copy of the Valid Arms License of the Weapon Holder.
(v) If Arms License is not renewed, an Affidavit on Rs 10/- Non Judicial Stamp Paper attested by Notary, sample at Appendix ‘G’.

(c) On Demise of a NSP Weapon Holder, the legal heirs may apply for retention as Family Heirloom on sentimental reasons.

(i) Details of the NSP Weapon Holder – Appendix ‘E’
(ii) Application from the Transferee – Appendix ‘B’
(iii) Certificate from the Transferee that “I am not in possession of any NSP weapon allotted to me through Ordnance or transferred by any other entitled person”- Appendix ‘C’
(iv) Photocopy of the Issue Voucher of the Weapon issued by the Ordnance Depot.
(v) In case of loss of Issue Voucher, an Affidavit as per Appendix ‘F’
(vi) Legal Heir Certificate
(vii) An Affidavit in original on Rs 10/- Non Judicial Stamp Paper from Legal Heir duly
attested by Notary as per Appendix ‘H’.
(viii) Death Certificate of the NSP Weapon Holder.
(ix) No Objection Certificate from the other Legal Heirs.

Note: If the sanction for retention is not granted by the SAC, the Weapon will be returned to the designated Ordnance Depot

(b) The weapon is required for my personal use.
(c) It will not be sold/transferred to any person not entitled under the above SAO.
(d) “I am not in possession of any NSP weapon allotted to me through Ordnance or transferred by any other entitled person” (in case of transferee is serving Officer) to be attached with this application. However, in case of retired Officer an affidavit on a Ten Rupees Non Judicial paper duly attested by Notary would attached with the application).
14. Certificate that “Not more than Two Weapons are held as stipulated in The Arms (Amendment) Act 2019 and Arms Rule 1962” will be attached with the Application

FORMAT FOR AFFIDAVIT WHEN THE ISSUE VOCHURE OF NSP WEAPON IS LOST/MISPLACED

 

1. I, ______________ ______________ presently residing at ______________ ______________ ______________ ______________ since ______________ ______________ do solemnly affirm that I am in possession of NSP weapon ______________ ______________ Registered No ______________ ______________ make ______________ ______________ allotted by IHQ of MoD (Army) vide letter No ______________ ______________ and issued by ______________ ______________ (Depot) vide Issue Voucher No ______________ ______________ date ______________ .

2. There are no documents available with me pertaining to issue of this weapon but it is confirmed that the weapon was issued from the Army.

3. The Validity of Arms Licence has expired on (date). However, I hereby solemnly affirm that in the event of any court case/legal matter pertaining to misuse of the weapon during the period of my possession will be defended by me and all expenses related to court/legal proceedings etc will be borne by me.

4. I further certify that the above weapon is not involved in any legal/court case.
