Reviewing pay and allowances of Armed Forces personnel

(a) when Government had decided to entrust the task of reviewing the pay and allowances of the Armed Forces to a Pay Commission in place of departmental Committee;
(b) what were the constraints for and circumstances before Government for such a decision;
(c) whether the terms of references for the Armed Forces and Civilians were same and why the pensions of Armed Forces Personnel were clubbed with Civilians; and
(d) whether mistake had been committed in 1973 by “Ex-parte Administrative Order” in the matter and why that cannot be corrected to treat Armed Forces Personnel a separate class?

(a) The Government entrusted the task to a Pay Commission in 1973, at the time of setting up of 3rd Central Pay Commission.

(b) The Government had set up a Post War Pay Committee in 1947, a departmental pay committee (Raghuramiah Committee) during 1959-60 and another Departmental Committee in 1967 for review of pay and allowances of Defence Forces Personnel. There was general discontentment amongst the Services with respect to the recommendations of these Committees. Thereafter, the Government decided to entrust the examination of structure of emoluments, including benefits in cash and kind and death cum retirement benefits of the Armed Forces to the 3rd Central Pay Commission.
(c) & (d): The terms of reference with respect to the Armed Forces personnel were different to the extent that the 3rd Central Pay Commission was not required to make recommendations on the conditions of service of the Armed Forces personnel. Though, the matters related to pension of Defence Service personnel was referred to 3rd Pay Commission, there has been no clubbing with civilians. The Commission felt that by and large, the principles followed by Armed Forces Pension Revision Committee (AFPRC) continue to be valid. The 3rd Pay Commission had considered the peculiar conditions of service and hierarchical set up of the Services, age of retirement, period of qualifying service pension etc. in respect of Armed Forces personnel. As such there has been no mistake in entrusting the matter to 3rd Central Pay Commission.

क्या रक्षा मंत्री यह बताने की कृपा करेंगे कि : 

(क) सरकार ने सशस्त्र सेना के कर्मियों के वेतन और भत्तों की समीक्षा करने का कार्य विभागीय समिति को देने के बजाए वेतन आयोग को सौंपने का निर्णय कब किया है ;

(ख)   ऐसा निर्णय लेने के पीछे सरकार की क्या मजबूरियां थीं व उसके समक्ष कौन सी परिस्थितियां थीं ;

(ग) क्या सशस्त्र सेना कर्मियों और असैनिक कर्मचारियों से संबंधित विचारार्थ विषय एक समान थे और सशस्त्र सेना के कर्मियों की पेंशन को असैनिक कर्मचारियों के साथ क्यों जोड़ दिया गया ; और

(घ) क्या इस विषय में वर्ष 1973 में “एक पक्षीय प्रशासनिक आदेश” द्वारा गलती की गई थी और सशस्त्र सेना कर्मियों को एक अलग वर्ग माने जाने के लिए इसमें सुधार क्यों नहीं किया जा सकता ?

(क)  : सरकार ने तीसरे केन्द्रीय वेतन आयोग की स्थापना के समय, 1973 में एक वेतन आयोग को कार्य सौंपा था ।
(ख): सरकार ने रक्षा बलों के कार्मिकों के वेतन एवं भत्तों की समीक्षा के लिए 1947 में युद्धोपरांत एक वेतन समिति, 1959-60 के दौरान एक विभागीय वेतन समिति (रघुरमैय्या समिति) और 1967 में एक अन्य विभागीय समिति बनाई थी । इन समितियों की सिफारिशों के संबंध में सेनाओं के बीच एक आम असंतोष था । तत्पश्चात् सरकार ने सशस्त्र बलों को नकदी एवं वस्तु और मृत्यु सह सेवानिवृत्ति के रूप में मिलने वाले लाभों सहित परिलब्धियों की संरचना की जांच का कार्य तीसरे वेतन आयोग को सौंपने का निर्णय किया ।

(ग) और (घ): सैन्य बलों के कार्मिकों के संदर्भ में संबंधित विचारार्थ विषय इस मायने में भिन्न थे कि तीसरे वेतन आयोग को सैन्य बलों के कार्मिकों की सेवा शर्तों पर सिफारिश करना अपेक्षित नहीं था । यद्यपि, रक्षा सेना कार्मिकों के पेंशन से संबंधित मामले को तीसरे वेतन आयोग को भेजा गया था, परन्तु इसे असैनिक कर्मचारियों के साथ नहीं जोड़ा गया । समिति ने माना कि कुल मिलाकर सैन्य बल पेंशन समीक्षा समिति (एएफपीआरसी) द्वारा अपनाए गए सिद्धांतों की वैद्यता बनी हुई है । तीसरे वेतन आयोग ने सैन्य बल के कर्मियों के संबंध में सेना की विशिष्ट परिस्थितियों और सेना की पद सोपानीय संरचना, सेवानिवृत्ति की आयु, अर्हकता सेवा पेंशन की अवधि इत्यादि पर विचार किया था । इस प्रकार, इस मामले को तीसरे वेतन आयोग को सौंपे जाने में कोई चूक नहीं हुई है ।

    Pension was granted to JCO/OR @ 70% of last pay drawn before 1973 and the same was brought down to 50% from 1973, this is ridiculous and problem of Defence Forces Pension started from then. The benefit of OROP though promised right from 1973 for JCOs/OR only, the same has been hijacked by retd officers, may be connived with Babus or Politicians. While retd officers have been granted 5 to 6 lakhs as arrears, JCOs with 28 to 30 years service have been bracketed within 12 to 20 thousand and the same treatment meted out to NCOs/OR, is it not discrimanity of highest order? why RM,FM and honourable PM can not deliver justice to JCOs/OR(the real fighters and Guards)? whom should we beseech, our Commanders never felt for us nor did anything good for our all round progress. we still have faith on our respected PM.   • As much questions dubious in nature are asked as replies dubious/making us fool will be generated. Simple question,if asked sincerely, should have been :-

    (a) WHY THE PERCENTAGE OF PENSION AUTH TO ARMED FORCES THEN WAS REDUCED W/O THEIR CONSENT/INTENT by 3rd PAY COMMISSION?

    (b) HOW THE CIV who were at 33% THEN BROUGHT AT PAR WITH ARMED FORCES BY 3rd PAY COMMISSION?

    (c) Does the Defence Minister / Govt of India have courage to redress this anomaly? If so , All questions of different annotation will be answered automatically.
