Fixation of pay on promotion on or after 1st day of January, 2016 – 7th CPC – Revised Pay Rules, 2016:-

Fixation of pay on promotion on or after 1st day of January, 2016.
—The fixation of pay in case of promotion from one Level to another in the revised pay structure shall be made in the following manner, namely:-

(i)
One increment shall be given in the Level from which the employee is promoted and he shall be placed at a Cell equal to the figure so arrived at in the Level of the post to which promoted and if no such Cell is available in the Level to which promoted, he shall be placed at the next higher Cell in that

(ii) In the case of Government servants receiving Non Practicing Allowance, their basic pay plus Non Practicing Allowance shall not exceed the average of basic pay of the revised scale applicable to the Apex Level and the Level of the Cabinet

    Sub.: – Anomaly caused in my pay fixation on regular promotion after under 7th CPC-Reg.
    Ref.: – No./1(90) Pay Fixation/Adm-I/55826 dated .10.2017 & No./ 1(90) Pay Fixation/Adm-I/538 dated 18.09.2018 serial no.-8.

    Respected Sir,
    With references to the above I wish to draw your kind attention towards following facts-
    1. That my pay was fixed as under, vide order No./1(90) Pay Fixation/Adm-I/558 26.10.2017 (copy attached dated) Annexure-I
    w.e.f. Stage
    PB-3, 15600-39100+GP 5400/- (Pre revised)
    As per 7th CPC in level-10, cell-9 05.09.2017 Rs. 71100/-
    DNI 01.07.2018

    2. That my pay was re-fixed as under, vide office order No./ 1(90) Pay Fixation/Adm-I/538 dated 18.09.2018 serial no.-8 (copy attached) Annexure-II
    Pay Band/ Pay Matrix Level w.e.f. Stage
    Pay fixed in the PB-3 i.e. 15600-39100+ GP 5400
    Level-10, Cell-8 05.09.2017 69000/-
    01.07.2018 Rs. 71100/-

    DNI 01.07.2019

    3. In this matter brief development of my salary is as below: –
    (A) I got MACP benefit and fixation in month 04/2016 Grade Pay 4600 to 4800, in
    the same A.O./E.O. Cadre w.e.f. from 17.05.2012.
    (B) As per 7th CPC my pay for the Month of August 2017 was PB 68000/-
    (C) I got promotion to new Cadre A.P.F.C. in the month of 09/2017 with Revised PB-
    ,15600-39100+GP 5400/- (pre-revised). As per 7th CPC pay in Level-10, Cell-9, PB
    should be 71100/-(as previously fixed wide order no.1 (90) / Pay Fixation /Adm.i
    /558 dated 26 OCT 2017 was correct), But after one year my pay was re -fixed
    wide office order No./ 1(90) Pay Fixation/Adm.-I/538 dated 18.09.2018, placed in
    Level-10, Cell- 8, in Stage of 69000/- which is wrong as per rule, I could not
    understand, how I was placed at Cell-8 Level-10, not clear.
    (D) That so said excess amount paid, was recovered from my salary during wage
    month from 09/2018 to 11/2018.

    5. As per rule13 (i)and (ii) of CCS (RP) Rules,2016, At the time of promotion on or after 01-01-2016, the fixation of pay in case of promotion from one Level to another in the revised pay structure shall be made as below- (Annexure-V)
    “One increment shall be given in the Level from which the employees promoted and shall be placed at a cell equal to the figure so arrived at in Level of the post to which promoted. If no such cell is available in the level to which promoted, he shall be placed at next higher cell in that Level”.
    Illustration— A Government servant drawing the pay of Rs. 28400 in the Pay Level 3
    is promoted to a higher post in the Pay LEVEL 4. His Pay will be fixed as: –

    Basic Pay in Level 3 … ………… 28400
    Pay after giving one increment ……. …….. 29300
    Pay in the promoted post in Pay Level …………… ……… 29600

    With the above reference in my case- I was drawing the pay of Rs.68000/- in the
    pay Level 8, promoted to a higher post in pay Level 10. My pay should be fixed as: –
    Basic Pay in Level 8 …….…. ……………….. 68000
    Pay after giving one increment in Pay Level 8 …………. ……. 70000
    Pay in the promoted post in Pay Level ….. ……. ……. .. 71100
    6. In this regard order no. S.No. PC-VII/127, No. PC-V/2016/MACPS/1 Dated 12.02.2019 copy attached. Also may be refer for fixation of pay. (Annexure-VI)
