New Delhi, the 23rd November 2020

No. A-12/11/20/Ayush-RR/2018-Med.-VI- In exercise of the powers conferred by sub-section (1) of section 97, read with clause (xxi) of sub-section (2) and sub-section (2A) of the said section and sub-section (2) and (3) of section 17 of the Employees ‘ State Insurance Act, 1948 (34 of 1948) and in supersession of the Employees’ State Insurance Corporation Medical Officer (Homoeopathy), Recruitment Regulations, 2009, except as respects things done or omitted to be done before such supersession, the Employees’ State Insurance Corporation hereby makes the following regulations regulating the method of recruitment to the posts of Medical Officer (Homeopathy) and Senior Medical Officer (Homeopathy) in Employees’ State Insurance Corporation, namely:-

1. Short title and commencement. – (1) These regulations may be called the Employees’ State Insurance Corporation, Medical Officer (Homoeopathy) and Senior Medical Officer (Homoeopathy), Group ‘A’ Posts, Recruitment Regulations, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application. – These regulations shall apply to the posts specified in column (1) of the Schedule annexed to these regulations.

3. Number of posts, classification and level in pay matrix. – The number of posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age-limit, qualifications etc.-The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.

5. Composition of Selection Board, procedure of Selection etc. in respect of posts for which direct recruitment is prescribed :

(1) Selection Board:

(i) The Selection Board shall consist of. –

(a) A part-time Chairman of the status of Secretary or Additional Secretary to the Government of India, who may be appointed by Secretary, Ministry of Labour and Employment, Government of India or the Director General, Employees’ State Insurance Corporation, with the specific prior approval of the Chairman, Employees’ State Insurance Corporation.

(b) Two Medical experts from the discipline or specialised filed pertaining to which recruitment is to be made, who may be chosen by the Chairman, Selection Board from the panel of experts maintained for the purpose by the Director General, Employees’ State Insurance Corporation.

(c) The Medical Commissioner, Employees’ State Insurance Corporation will be the departmental representative in New Delhi and in case of other States, the Additional Commissioner or Regional Director of the respective States will be departmental representative. In case, these officers are not available for some reason then Director General can nominate some other officer as the departmental representative .

(ii) The term of office of the part-time Chairman shall ordinarily be one year from the date of constitution of the Selection Board. His term may, however, be curtailed or extended by the Director General, with the specific prior approval of the Chairman, Employees’ State Insurance Corporation.

(iii) The part-time Chairman and the Medical Experts shall be entitled to traveling allowances, sitting fees etc. at much rates as may be fixed by the Director General from time to time keeping in view the rates prescribed by the Central Government.

(2) Procedure and manner of Selection. –

(a) Direct recruitment to the posts included in the schedule, wherever applicable, shall ordinarily be made at All India level on the basis of a written examination followed by an interview of eligible and successful candidates.
In case, it becomes necessary to adopt a different mode of recruitment, the same may be adopted by the Director General after obtaining specific prior approval of the Chairman, Employees’ State Insurance Corporation . However, once a mode of recruitment is notified in the advertisement, no change shall be made subsequently.

(b) The number of candidates to be invited for interview shall be decided by the Chairman, Selection Board, keeping in view the number of vacancies and the number of applicants who satisfy the prescribed requirement.

(c) Mere fulfillment of the prescribed requirement of age, qualification, experience etc. will not confer any right on the applicant to be called for interview or to any claim over the post advertised.

(d) All work relating to issue of advertisement in respect of applications and processing of applications for submission to the Chairman, Selection Board will be handled by the office of the Director General, Employees’ State Insurance Corporation.

(e) The Selection Board will be provided necessary Secretarial assistant by the office of the Director General, Employees’ State Insurance Corporation.

6. Disqualification. – No person, –

(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts:

Provided that the Director General of the Employees’ State Insurance Corporation may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this regulation.

7. Power to relax. – Where the Director General of the Employees’ State Insurance Corporation is of the opinion that it is necessary or expedient so to do, he may, by order, for reasons to be recorded in writing and after obtaining specific prior approval of the Chairman, Employees’ State Insurance Corporation, relax any of the provisions of these regulations with respect to any class or category of persons.

8. Residuary Matters. – Subject to the provisions of these regulations all other regulations and conditions as specified in the Employees’ State Insurance Corporation (Recruitment) Regulation, 1965 as amended from time to time applicable to the corresponding categories of posts in Employees’ State Insurance Corporation shall apply to the posts specified in the Schedule annexed to these regulations.

9. Savings. – Nothing in these regulations shall affect reservation, relaxation of age- limit and other concessions required to be provided for the Scheduled Castes, the Schedules Tribes, the Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
