OFFICE MEMORANDUM

Subject: Granting of Annual Increment on retirement: Notional Extension of Supreme Court Verdict in favour similarly placed Non-petitioner employees.

The undersigned is directed to refer to letter dated 07.06.2020 received from the General Secretary/BPMS & Member, JCM-II Level Council (MoD) regarding the above mentioned subject (copy enclosed).

2. In the aforesaid letter, BPMS have referred the judgment dated 11.04.2023 in the case of ‘The Director (Admn and HR) KPTCL & Ors Vs. C.P. Mundinamani & Ors (Civil Appeal No 2471 of 2023, decided on 11.04.2023)’ passed by Hon’ble Supreme Court and requested to extend the benefits of this judgement to all similarly placed non-petitioner employees who have retired in the past and were denied the benefit of annual increment on the ground of their retirement.

3. As DoP&T is the Nodal Agency in the subject mentioned above. Therefore, BPMS letter dated 07.06.2023 is hereby forwarded to DOP&T for consideration. Direction, if any, in this regard may please be intimated to this division.

    My appeal is addressed to the Competent Authorities with Government of India deciding on grant of increment on retirement to government servants.

    May, I request our Government to decide on granting a calculated percentage of increment on retirement. Especially, to those retiring up to Level-11.

    It may be appreciated that we government servants are required to serve, with absolute integrity holding respective positions. Also, the entire job output is of a ‘Team Work’ right from the lower level post up to the higher echelon.

    Pay fixation on promotions up to Level-11 are done with only one increment. Whereas, the same from Level-12 onwards are getting fixed with two increments.

    Keeping the dignity of a retiring Government servant in mind and in trying to bring some parity as equal partners in discharging service, may I suggest the following for consideration of Higher Authorities :-

    i) Retiring after seven (07) months on grant of annual increment either in Jul or Jan, can an increment of 1.5% be granted to the last basic pay on retirement.

    ii) Similarly, depending upon completed months of service, seven month onwards post grant of annual increment, on retirement, the percentage of increment on last Basic Pay can go as 1.75%, 2%, 2.5%, 2.75% and finally 3% to those retiring on 30th Jun and 31st Dec.

    iii) Here, would like to request in considering those government servants who take VRS after serving for 33 years.

    iv) As such the Competent Authorities would appreciate that employees who opt for VRS actually surrender their future prospects on promotion (that comes with financial gain) along with pay and perks for their remaining service.
    Isn’t that a financial relief to the Government.

    Request for a due consideration by authorities at all Legal and Ministerial levels. In case, found justified, would further add that NO arrears whatsoever is expected. Implementation itself, would be of a High Honour to a Retiring Government Servant in realising at par to higher posts as said earlier we work as a Team.

    I Rest my appeal / Request, purely on Judicious Realization and Wisdom of the Competent Decision Making Authorities.

    After our death center government will give of one notional increment of retired pensioners those are retired 30 June.
