RULES FOR PAYMENT OF GRATUITY FOR PAST SERVICE

2116. SMT. SUMITRA BALMIK:
Will the PRIME MINISTER be pleased to state:

(a) the details of rule position which allows an NPS employee, who moved from autonomous body to Government with proper permission and technical resignation, to opt not to have past service rendered in autonomous body counted in Central Government and to receive payment of gratuity for past service;

(b) the rule prescribing payment of interest towards delayed disbursal of gratuity by autonomous body where an NPS employee moves to Government and has opted to receive gratuity for past service; and

(c) the details of rule position or judicial decisions that define whether a service duration of 4 years 9 months qualifies for gratuity payment?

(a): The Department of Pension and Pensioners’ Welfare (DoPPW) has notified the Central Civil Services (Payment of Gratuity under National Pension System) Rules, 2021 for Central Government civilian employees. These rules are not suo moto applicable to the employees of autonomous bodies. However, DoPPW vide Office Memorandum (OM) No.7/5/2012-P&PW(F)/B dated 12th February, 2020 provides that on mobility from Autonomous Bodies having National Pension System (NPS) with provision of retirement / death gratuity for its employees similar to that in the Central Government, the service rendered in the Autonomous Body would be counted for grant of gratuity in Central Government subject to condition that the employee resigns with proper permission to take another appointment in the Government.

(b) & (c): The payment of gratuity, payment of interest or counting of service duration etc by the autonomous bodies depends on the particular gratuity rules being followed by the particular Autonomous Body as the rules of DoPPW are not suo moto applicable to the employees of autonomous bodies.

क्या प्रधानमंत्री यह बताने की कृपा करेंगे कि:

(क) किस नियम के तहत एक एनपीएस कर्मचारी, जो उचित अनुमति और तकनीकी त्यागपत्र के साथ एक स्वायत्त निकाय से सरकारी निकाय में स्थानांतरित हुआ है, उसे केंद्र सरकार में स्वायत्त निकाय में की गई पिछली सेवा की गणना न करने और पिछली सेवा के लिए ग्रेच्युटी का भुगतान प्राप्त करने का विकल्प चुनने की अनुमति प्रदान की जाती है;

(ख) स्वायत्त निकाय द्वारा किस नियम के तहत ग्रेच्युटी के विलंबित संवितरण पर ब्याज के भुगतान का प्रावधान करता है, जिसमें कोई एनपीएस कर्मचारी सरकारी निकाय में स्थानांतरित होता है और पिछली सेवा के लिए ग्रेच्युटी प्राप्त करने का विकल्प चुनता है; और

(ग) क्‍या 4 साल 9 महीने की सेवा अवधि ग्रेच्युटी शा गतान के लिए योग्य है और इसे परिभाषित करने वाले नियमों की स्थिति या न्यायिक निर्णयों का ब्यौरा क्या है?

(क) : पेंशन एवं पेंशनभोगी कल्याण विभाग (डीओपीपीडब्ल्यू) ने केंद्र सरकार के सिविल कर्मचारियों के लिए केंद्रीय सिविल सेवा (राष्ट्रीय पेंशन प्रणाली के अंतर्गत उपदान का संदाय) नियम, 2021 अधिसूचित किए हैं। ये नियम स्वायत्त निकायों के कर्मचारियों पर स्वतः लागू नहीं होते हैं। तथापि, पेंशन एवं पेंशनभोगी कल्याण विभाग ने 12 फरवरी, 2020 के कार्यालय ज्ञापन संख्या 7/5/2012-पी&पीडब्ल्यू(एफ)/बी द्वारा यह प्रावधान किया है कि केंद्र सरकार की तरह ही अपने कर्मचारियों के लिए सेवानिवृत्ति/मृत्यु उपदान के प्रावधान के साथ राष्ट्रीय पेंशन प्रणाली (एनपीएस) वाले स्वायत्त निकायों से, केंद्र सरकार में कार्यभार ग्रहण करने पर, केंद्र सरकार में उपदान की देयता के लिए, स्वायत्त निकाय में दी गई सेवाओं की गणना की जा बशर्ते कि कर्मचारी ने सरकार में दूसरी नियुक्ति लेने के लिए उचित अनुमति लेकर त्यागपत्र दिया हो।

(ख) और (ग): किसी भी स्वायत्त निकाय द्वारा किए जाने वाला उपदान का भुगतान, ब्याज का भुगतान या सेवा अवधि की गणना आदि उस स्वायत्त निकाय द्वारा प्रशासित उपदान नियमों के अनुसार किया जाता है क्‍योंकि पेंशन एवं पेंशनभोगी कल्याण विभाग के नियम स्वायत्त निकायों के कर्मचारियों पर स्वतः लागू नहीं होते हैं।
