Central Secretariat employees demand timely promotions

Central Secretariat employees have demanded removal of stagnation in Services and facilitation of timely promotions. A deputation of “Central Secretariat Services Forum” led by its Convenor, Shri D.N.Sahoo called on Dr Jitendra Singh, Minister of State Personnel, here today and thanked him for his positive and cooperative response to all their grievances in the past one year and expressed the hope that he would also find a way out to overcome the anomaly in Services which has been adversely affecting them for the last several years. They also handed over a memorandum to him.
Dr Jitendra Singh assured that the problems and grievances faced by the employees will certainly be resolved and observed that the Department of Personnel & Training (DoPT) had, on his instructions, sent a favourable proposal in support of their demands but there were certain technical queries from the Finance Ministry which are also in the process of being replied.
Dr Jitendra Singh said the Modi Government took over with a pledge for ‘maximum Governance, minimum Government’ and adopted several radical measures to simplify governance and provide a comfortable and work-friendly environment for its officials. It is in the same spirit that the officials of different Secretariat Services are also intended to be made comfortable and achieve a sense of esteem through timely promotion and befitting status in their service career, he added.
The members of the deputation submitted to Dr Jitendra Singh that as per the Central Secretariat Service Rules, promotion from Under Secretary to Deputy Secretary, for example, requires only five years of approved service in a total of about 30 years of service period but the irony is that several of the employees who have already put in 20-22 years of service are still awaiting promotion and many of them attain superannuation as Under Secretaries or even Section Officers. They said that since there is no financial implication involved and Dr Jitendra Singh has the reputation of being sympathetic to the cause of employees, it is hoped that their grievances will be addressed in the right earnest.
Among the members of the deputation were S/Shri Pradeep Kumar Singh, R.P.Gupta, V.Sreekumar, Mrityunjay Jha, Ashok Kumar, Manoj Kumar Singh, Brajesh Sikka, Kumar Manoj Kashyap, R.P.Sati, Ujjwal Kumar and P.K.Sharma.

Minutes of the meeting held under the chairmanship of Shri Sanjay Kothari, Secretary, DOP&T on 28.05.2015 at 04:00 P.M to consider the cases of inter cadre deputation/ inter cadre transfer/ extension of inter cadre deputation

Meeting was held under the Chairmanship of Secretary (P) on 28.05.2015 at 04:00 P.M to consider the cases of inter cadre deputation/ inter cadre transfer/extension of inter cadre deputation/ over-stayal on inter cadre deputation. During the meeting, BO & AS and AS(S&V) who are members of the committee were also present. Besides, Dir(AIS), US(S-II) and US(AVD-I) were also present to assist the Committee in the meeting;
2. At the outset, the Committee reviewed the decision taken on the proposals considered in its last meeting dated 13.05.2015. It was brought to the notice of the Committee that in case of Mr. Aparna U., IAS (UP:01), Ms. Sweta Sachan, IAS(MT:14), fresh vigilance status have not yet been received from AVD-I. AVID-I has again been requested to expedite the same. The proposal of cadre change in respect of Sh. Parth Gupta, IAS,.(AGMUT:13) and Shri Varun Rajan, IAS(UP:14) have since been approved by the Competent Authority and notifications have been issued and put on the website. In case of Ms. Bhavya Mittel, IAS(MT:14), Shri Vijay N. Zede, IAS(PB:02), Dr. Adapa Kaushik, IAS(PB:08), Shri Bhabal Jain, IAS(WB:14), Shri Ghopal Ramesh Gorath, IAS(JH:12), Ms. Monica Gupta, IAS(AM:14), Shri Shiraz Daneshyar, IAS(WB:14), comments of concerned State Governments have been sought with copy marked to the officer concerned. The proposal of Ms. Riju Bafna, IAS (CH:14) and Ms. Ashima Jain, IAS(BH:08) are under consideration of the Competent Authority for approval. The cases of cadre change of Shri Kuldeep Sharma, IAS (CG:14) and Ms. Radhika Ayer, IAS(VVB:11) on the basis of PH policy have again been put up before the Committee on 28.05.2015 with reference to their subsequent requests. Regarding the case of Ms. Nidhi Pandey, IAS ( MH:01), it was decided to keep the proposal pending.
3. Thereafter the Committee took up all proposals one-by-one and after detailed deliberations and careful consideration in each case, the following decisions have been taken in the meeting:

CASE 1: Shri Ranjit Kumar Singh IAS (GJ: 08) Inter cadre deputation from Gujarat cadre to Bihar cadre.

The officer had applied for inter cadre deputation on the grounds of ill-health of old aged mother, as a result of an accident, ill-health of old aged father and ill-health of himself. The Committee was informed that earlier the officer had applied for cadre change and inter cadre deputation on grounds of his ill-health but the same were not recommended by the Committee. The Committee again decided not to recommend the case of the officer for inter cadre deputation to Bihar cadre as the officer has not completed required 9 years of service in his parent cadre and directed to incorporate the case in the quarterly report to be submitted to ACC and the officer to be informed about the above decision.

CASE 2: Shri Rajesh Singh Rana, IAS (CG:08) Inter cadre deputation from Chhattisgarh cadre to AGMUT cadre (Delhi segment).

The Committee was informed that the officer has requested for inter cadre deputation because of ill-health of father, younger and elder brother of the officer. The Committee was further informed that Hon’ble Chief Minister, Delhi Government has desired that the services of the officer to be placed at the disposal of Government of NCT of Delhi. The Committee decided not to recommend the case of the officer for inter cadre deputation to AGMUT cadre (Delhi segment) as the officer has not completed required 9 years of service in his parent cadre and directed to incorporate the case in the quarterly report to be submitted to ACC and the officer to be informed about the above decision.

CASE 3: Shri Vijay Amruta Kulange, IAS(OR:13) Cadre Change from Orissa cadre, on the basis of PH (Physically Handicapped) policy dated 14.02.2014.

The Committee was shown the medical board report of the officer. The Committee “agreed in-principle” with the proposal and directed that comments of all the concerned State Governments may be called for with a copy marked to the officer.

CASE 4:Shri Abhishek Singh, IAS (TR:06) Inter cadre deputation from Tripura cadre to Bihar cadre.

The Committee was informed that the officer had requested for inter cadre deputation on the grounds of ill health of his father-in-law, but no medical documents have been provided by the officer. The Committee was further informed that the officer being of 2006 batch will complete 9 years of service on 1st July 2015. Taking into consideration of the fact that the officer has only one month left for completion of the required 9 years of service, the Committee directed that comments of the State Government of Tripura may be called for and a copy of the letter be endorsed to the concerned officer and after receipt of the NOC from both the states and vigilance clearance, ACC note for the proposal may be submitted for consideration and approval of ACC.

CASE 5: Ms Jaspreet Kaur, IAS(MN:13) Change of cadre or service from Manipur cadre to a more suitable cadre due to special circumstances.

The Committee was informed that the officer has mentioned that prior to her being allocated to IAS, she was part of IRS(Custom & Central Exercise), 2010 batch and is holding lien on her previous service upto August 2015. Her spouse is also IRS(C&CE) who is posted in Delhi. She is unable to lead normal family life and is left with no other option but to revert back to her previous service i.e IRS(C&CE) unless she is adjusted in some appropriate cadre. The Committee decided not to recommend the case of the officer for cadre change to any other cadre as the same is not covered under the policy and directed to incorporate the case in the quarterly report to be submitted to ACC. The Committee further directed that the officer may be informed of the above decision. The Committee further observed that in case her spouse is willing to go to Manipur, such proposal may be considered.

CASE 6: Shri Mohan Lal Meena, lAS (MT: 01) Inter cadre transfer from Manipur-Tripura cadre in pursuance of Hon’ble CAT, Jabalpur Bench order dated 01.10.2013, on the grounds of extreme hardship i.e threat perception to the officer.
The Committee was informed that Shri Meena had applied for change of cadre from Manipur-Tripura cadre on the grounds of threat perception. Having obtained IB report, a proposal was put up for consideration of the Government. The Government approved inter cadre deputation from Manipur- Tripura cadre to Madhya Pradesh cadre for a period for 3 years. The Committee was further informed that Shri Meena had filed OA before CAT Jabalpur Bench contending that he had applied for change of cadre and therefore approval of inter cadre deputation by the Government is not correct. The Hon’ble Tribunal vide its Order dated 01.10.2013, has disposed off, the OA with the following directions:

” To examine the request of the applicant for his inter cadre transfer from his parent state of Manipur- Tripura to the state of Madhya Pradesh, and take a decision, if not already decided, as per policy of change of cadre of All India Service Officers, and pass appropriate orders expeditiously and till then the applicant may be permitted to continue on deputation in the cadre of state of Madhya Pradesh.”

The Committee was also informed that this case was discussed in its earlier meeting held on 30.03.2015 and 02.04.2015. As directed fresh IB report was called for and the same has been received on 18.05.2015. The Committee perused the IB report and decided not to recommend his case for change of cadre to Madhya Pradesh. The Committee further directed that the possibility of having Shri Meena on central deputation may be explored, by waving of “cooling-off’ period.

CASE 7: Shri Chinmay Pundlikrao Gotmare , IAS (AM:09) Change of cadre from Assam- Meghalaya cadre to either of Madhya Pradesh, Rajasthan, Gujarat, Chhattisgarh- or Telangana/ Inter cadre deputation as interim relief.
The Committee was informed that earlier the case was put up before the Committee in its meeting held on 18.12.2014 and then Committee had observed that IB Report as well as Government of Meghalaya (parent cadre) had not confirmed the claim of officer for threat perception. Accordingly, the Committee had not recommended his case for change of cadre. The Committee was further informed that now the officer has requested again to get the threat perception re-assessed and pending decision on change of cadre as interim relief he may be considered for inter cadre deputation. The Committee reiterated its earlier decision not to recommend his case for change of cadre. Also the Committee decided not to recommend the case of the officer for inter cadre deputation as the officer has not completed required 9 years of service in his parent cadre and directed to incorporate the case in the quarterly report to be submitted to ACC and the officer to be informed about the above decision. In case the officer applies for central deputation, the same may be considered.

CASE 8: Shri KuIdeep Sharma, IAS(CG:14) Cadre Change from Chhattisgarh cadre, on the basis of PH (Physically Handicapped) policy dated 14.02.2014.

The Committee was informed that the proposal was earlier placed before the Committee in its meeting held on 13.05.2015 wherein the Committee directed that ACC note for policy decision inter-alia for such cases where the officer is already in geographically contiguous state, be put up. The Committee was also informed that the officer has now referred to the above decision of the Committee and inter-alia mentioned that the case where an officer is already allotted a state contiguous to home state is not precluded in the policy dated 14.02.2014. The Committee directed that draft for review of PH policy may be put up expeditiously.

CASE 9: Ms K Radhika Aiyar, IAS(WB:11) Cadre Change from West Bengal cadre, on the basis of PH (Physically Handicapped) policy dated 14.02.2014.

The Committee was informed that two states geographically contiguous to Delhi the home state of the officer are Haryana and Uttar Pradesh. Third state closest to Delhi in terms of distance is Uttarakhand (as searched through google). However, the order of preference for states given by the officer is Rajasthan, Madhya Pradesh and Haryana. Accordingly, comments of only State Government of Haryana have been sought. The Committee was also informed that in other cases of cadre change on the basis of PH policy dated 14.02.2014, where the home state of the officer is Delhi, Uttarakhand has
been taken as the third state closest to Delhi, in terms of distance. However, the officer had requested that Rajasthan cadre which is the closest to her home state may also be requested for NOC. The Committee decided not to seek comments of the Rajasthan Government. The Committee further directed that the draft for review of PH policy may be put up expeditiously.

CASE 10: Ms Swati Srivastava, IAS(CG:12) Inter cadre transfer from Chhattisgarh cadre to Uttarakhand cadre on the ground of marriage to Shri Nitin Singh Bhadauria, IAS(UK:11).

It was decided that in view of “Consent” received from Government of Chhattisgarh the proposal of cadre change on the ground of marriage which is now complete in all respect, may be put up for the approval of the Competent Authority.

Miscellaneous Decisions

(i) While reviewing the status of the proposal for Inter cadre deputation of Dr Adapa Karthik, IAS(PB:08) from Punjab cadre to AGMUT cadre for appointment to the post of Secretary (below superfine scale) in Chandigarh Administration for a period of 3 years, the Committee directed that the cases pertaining to post specific deputation in Chandigarh Administration need not be put up before the Committee.
(ii)  The Committee further decided that the proposals relating to change of cadre of IAS officers under PH policy where medical examinafion is complete and report has been received may be put up on File for consideration of “in-principle approval”. Such proposals need not be put up before the Committee.
