PENSION FOR PARAMILITARY FORCES

Will the Minister of Finance be pleased to state:

(a) whether armed forces were marked as exception to New Pension Scheme (NPS) and if so, the details thereof;

(b) whether Article 246 of the Schedule VII of the Constitution says armed forces of the Union of India include Naval, Military and Air Force and any other armed forces of the Union;

(c) if so, whether Hon. High Court of Delhi has asked the Union Government to issue orders for Old Pension Scheme to Central Armed Police Forces like CRPF, ITBP, CISF etc.;

(d) if so, whether the Government has since issued orders in this regard; and

(e) if so, the details thereof and if not, the reasons therefor?

THE MINISTER OF STATE IN THE MINISTRY OF FINANCE
(DR. BHAGWAT KARAD)

(a) to (e) As per Gazette Notification No. 5/7/2003-ECB & PR dated 22.12.2003 issued by Department of Economic Affairs, Ministry of Finance, the Government introduced a new restructured defined contribution pension scheme for new entrants to Central Government service, except the armed forces, in the first stage, replacing the existing system of defined benefit pension system. The system is mandatory for all new recruits to the Central Government service from 01.01.2004.

The Hon’ble High Court of Delhi vide order dated 11.01.2023 in WP (C) No. 12712/2021 titled Pawan Kumar & Ors of CRPF Vs Uol & Ors and other connected matters, has directed for grant of Old Pension Scheme to the personnel of para-military forces. This is a policy matter under the domain of Ministry of Home Affairs.

अर्द्ध सैनिक बलों को पेंशन

470. श्री असादुद्दीन ओवैसी:
क्या वित्त मंत्री यह बताने की कृपा करेंगे कि:

(क) क्या सशस्त्र बलों को नई पेंशन योजना (एनपीएस) के अपवाद के रूप में चिह्नित किया गया था और यदि हां, तत्संबंधी ब्यौरा क्या है;

(ख) क्या संविधान की सातवीं अनुसूची, अनुच्छेद 246 में उल्लेख है कि भारत संघ के सशस्त्र बलों में नौसेना, सेना और वायु सेना और संघ के अन्य सशस्त्र बल शामिल हैं;

(ग) यदि, हां तो क्या माननीय दिल्ली उच्च न्यायालय ने केंद्र सरकार से केंद्रीय सशस्त्र पुलिस बलों जैसे सीआरपीएफ, आईटीबीपी, सीआईएसएफ आदि के लिए पुरानी पेंशन योजना हेतु आदेश जारी करने को कहा है;

(घ) यदि हां, तो क्या सरकार ने इस संबंध में अब तक कोई आदेश जारी किया है; और

(ङ) यदि हां, तो तत्संबंधी ब्यौरा क्या है और यदि नहीं, तो इसके क्या कारण हैं?

(क) से (ड.): आर्थिक कार्य विभाग, वित्त मंत्रालय, भारत सरकार द्वारा जारी की गई दिनांक 22.12.2003 की राजपत्र अधिसूचना सं. 5/7/2003-ईसीबी एंड पीआर के अनुसार सरकार ने निर्धारित लाभ पेंशन योजना की मौजूदा प्रणाली के स्थान पर पहले चरण में सशख्र सेनाओं को छोड़कर केंद्र सरकार की सेवा में आने वाले नए कर्मचारियों के लिए एक नयी पुनर्सरचित निर्धारित अंशदायी पेंशन योजना आरंभ की थी। यह प्रणाली दिनांक 1.01.2004 से केंद्र सरकार की सेवा में नियुक्त होने वाले सभी नये कर्मचारियों के लिए अनिवार्य है।

माननीय दिल्ली उच्च न्यायालय ने सीआरपीएफ के पवन कुमार और अन्य बनाम भारत संघ व अन्य द्वारा रिट याचिका (सी) सं. 121712/2021 और अन्य संबंधित मामलों में दिनांक 11.01.2023 के आदेश के द्वारा अर्द्धसैनिक बलों के कार्मिकों को पुरानी पेंशन योजना देने के निदेश दिए हैं। यह गृह मंत्रालय के अंतर्गत आने वाला नीतिगत मामला है।
