Sub: Review of orders of deemed suspension – reg.
Attention is invited to para 4 of Board’s letter No. ED&A)2014RG6-35 dated 18.02.2015 advising that in cases of deemed suspension under sub rule (2) of rule 5 of Railway Servants (Discipline and Appeal) Rules, 1968, the period of 90 days laid down for reviewing the said suspension will be counted from the date the Railway Servant was released from detention.
2. Board have reviewed the matter and in partial modification of the position advised in para 4 aforesaid, decided that the period of 90 days for reviewing deemed suspension, will be counted from the date the Railway servant concerned was released from detention or the date when the fact of his release from detention comes to the notice of the competent authority, whichever is later.
