Sub: Sharing of information regarding favourable judgment of Hon’ble Supreme Court dated 23.07.2026 in Civil Appeal No. 9346/2026 arising out of SLP(C) No. 35363/2025 (Union of India & Others Vs. Harbans Lal Verma) and connected matters regarding MACPS to Guards category.
Please find enclosed a copy of judgment dated 23.07.2026 of the Hon’ble Supreme Court of India disposing of Civil Appeal No. 9346/2026 arising out of SLP (C) No. 35363/2025 and connected matters (Union of India & Ors. Vs. Harbans Lal Verma). In the aforesaid judgement, Hon’ble Supreme Court vide Para 65 (iv) has inter alia observed that MACP upgradation cannot exceed the Grade Pay ceiling of the promotional hierarchy and upheld the provisions contained in RBE No. 142/2012.
2. It is advised that the aforementioned judgment of the Hon’ble Supreme Court may please be brought to the notice of all the concerned including the officials of the Divisions with instructions to ensure its effective utilisation while contesting the cases involving identical issue.
