New Delhi, the 27th July, 2020

G.S.R. 473(E).—In exercise of the powers conferred by sub-section (1) read with clause (b) of sub-section (2) of section 40 of the Protection of Human Rights Act, 1993 (10 of 1994), and in supersession of the national Human rights Commission (Group ‘A’ and Group ‘B’ Posts) Recruitment Rules, 1996, in so far as they relate to the posts of Registrar (Law), Joint Secretary, Deputy Inspector General, Director, Joint Registrar, Private Secretary, Senior Superintendent of Police, Assistant Registrar, Under Secretary, Senior Research Officer, Special Assistant/ Private Secretary/ Principal Private Secretary, Senior System Analyst, Information and Public Relations Officer, Programmer, Assistant Accounts Officer, Assistant Director (Hindi), Senior Translator (Hindi), Research Assistant, Programmer Assistant and Junior Translator (Hindi); and in supersession of the National Human Rights Commission (Group ‘C’ and Group ‘D’ Posts) Recruitment Rules, 1996, in so far as they relate to the posts of Assistant Librarian, Junior Accountant, Stenographer Grade ‘D’, Lower Division Clerk, Despatch Rider, Constable, Library Attendant, Daftry, Peon, Farash and Safai Karamchari; and in supersession of the National Human Rights Commission (Staff Car Drivers Group ‘C’ Posts) Recruitment Rules, 2003 and the National Human Rights Commission (Conditions of Service of Officers and Staff) Rules, 2000 except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules, namely

1. Short title and commencement.– (1) These rules may be called the National Human Rights Commission (Salaries, Allowances and Conditions of Service of Officers and other Staff) Rules, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definition .- In these rules, unless the context otherwise requires, “Commission” means the National Human Rights Commission constituted under Section 3 of the Protection of Human Rights Act, 1993 (10 of 1994).

3. Officers and Staff of the Commission .- The nature and categories of the officers and staff of the Commission and the method of recruitment and the level in pay matrix attached thereto shall be as specified in the schedule appended to these rules.

4. Conditions of Service .- The conditions of service of the officers and staff of the Commission in the matter of pay, allowances, leave, provident fund, age of superannuation, pension and retirement benefits and other conditions of service, shall be regulated in accordance with such rules and regulations as are applicable to officers and staff belonging to the Central Government, as the case may be, of the corresponding level in pay matrix attached to these posts, subject to the approval of competent authority in the matter.

5. Medical facilities .- The officers and staff of the Commission in the matter of medical facilities shall be covered under Central Government Health Scheme facilities.
6. Number of posts, Classification and level in the pay matrix.- The number of posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

7. Method of recruitment, age-limit and other qualifications.– The method of recruitment to the said posts, age- limit, qualifications and other matter relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

8. Initial Constitution.- (1) The incumbent holding the posts of Chief Coordinator (Training), Presenting Officer, Deputy Registrar, Joint Director (Research), Deputy Secretary, System Analyst, Assistant Information Officer, Research Officer, Librarian/ Documentation Officer, Senior Research Assistant, Deputy Documentation Officer, Accountant and Upper Division Clerk on regular basis, immediately before the commencement of these rules, shall be deemed to have been appointed in accordance with the provisions of these rules.

(2) The regular continuous service of incumbent referred above in the respective grade immediately before the commencement of these rules shall count for the purpose of probation period, seniority, qualifying service for promotion, confirmation and pension in the service.

9. Appointing Authority .- (1) All appointments to the posts mentioned from serial number 1 to serial number 23 of column (1) of the said Schedule, shall be made by the Chairperson, National Human Rights Commission.
(2) All appointments to the posts mentioned from serial number 24 to serial number 33 of column (1) of the said Schedule, shall be made by the Secretary General, National Human Rights Commission.
(3) All appointments to the posts mentioned from serial number 34 to serial number 44 of column (1) of the said Schedule, shall be made by the Director, National Human Rights Commission.

10. Disqualification .- No person, –
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person; [shall be eligible for appointment to the said posts]:
Provided that the Central Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

11. Powers to relax .- The powers to relax any of the provisions of these rules with respect of any class or category of persons shall vest with the Chairperson, National Human Rights Commission to be exercised in consultation with the Central Government.

12. Saving .- Nothing in these rules shall affect reservation, relaxations of the age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, ex- servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.
