NOTIFICATION
New Delhi, the 14th September, 2020
G.S.R. 553(E).— In exercise of the powers conferred by sub-section (1) and clause (b) of sub-section (2) of section 30, read with section 30A of the Railway Claims Tribunal Act, 1987 (54 of 1987), the Central Government hereby makes the following rules further to amend the Railway Claims Tribunal (Salaries and Allowances and Conditions of Services of Chairman, Vice-Chairman and Members) Amendment Rules, 1989, namely:-
1. Short Title and Commencement.- (1) These rules may be called the Railway Claims Tribunal (Salaries and Allowances and Conditions of Services of Chairman, Vice-Chairman and Members) Amendment Rules, 2020.
(2) They shall be deemed to have come into force with effect from the 24th day of September 2012.
2. In the Railway Claims Tribunal (Salaries and Allowances and Conditions of Services of Chairman, Vice Chairman and Members) Rules, 1989, in rule 8, after sub-rule (5) and before proviso the following shall be inserted, namely:-
“(6)(i) The financial benefits in past cases will accrue with effect from 24th September, 2012.
(ii) This will be applicable to all the retired Members who have joined Railway Claims Tribunal before 12.02.2020:

Explanatory Memorandum: It is certified that, by giving this notification retrospective effect no Member shall be adversely affected.
Note: The principal rules were published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub Section (i) vide notification number G.S.R. 844(E), dated the 19th September, 1989 and last amended vide notification Number G.S.R.1086(E), dated the 5th November, 2018.
