Appointment of Anomaly Committee after the 6th Pay Commission

3397 Dr. Amar Patnaik:

Will the Minister of Education be pleased to state:

(a) whether the non-appointment of Anomaly Committee after the 6th Pay Commission has been challenged by teachers of the Central Universities and colleges against UGC/Ministry of Education/respective State higher education departments in various State High Courts and the Supreme Court of India;

(b) the details of orders/judgments passed by respective State High Courts and the Supreme Court of India;

(c) whether the UGC and the Ministry have been made parties to these cases;

(d) the action UGC and the Ministry have taken after receiving these orders/judgments of the courts; and

(e) if no action has been taken, the reasons therefor?

(a) to (e): University Grants Commission (UGC) has informed that it constituted an Anomaly Committee to deliberate on issues concerning the revision of pay scales, eligibility criteria, selection procedure for various posts, etc., under the Chairmanship of Prof. S.P. Thyagarajan on 9th January, 2009. Subsequently keeping in view the communication of Ministry of Education and several representations received from various stakeholders citing anomalies in the provisions contained in the UGC Regulations, 2010 and in order to address these anomalies, the UGC constituted another Committee to revisit UGC Regulations, 2010 under the Chairmanship of Prof. M. Anandakrishnan on 1st December, 2011. This Committee identified 67 areas in the Regulations, 2010 where certain modifications /amendments were required.

The Revisit Committee also appointed a sub committee headed by Prof. A.N. Rai. Thereafter, a Committee under the Chairmanship of Prof. Furqan Qammar was constituted to revisit the financial implication of the Regulations, 2010. The recommendations of Anomaly Redressal Committee (ARC) report were forwarded to the Pay Review Committee (PRC) constituted for 7th Central Pay Commission (CPC).

The Orders / Judgments of the courts are taken up for compliance in light of the extant regulations on case to case basis.
