OPTION FOR PAY FIXATION UNDER STATUTORY RULES

2590. SHRI SRIBHARAT MATHUKUMILLI:

Will the Minister of Finance be pleased to state:

a) whether pay fixation on promotion/financial upgradation of Central Government employees is governed by Statutory Rules namely the Central Civil Services (Revised Pay) Rules, 2016 and Fundamental Rule FR 22(i)(a)(1);

b) if so, whether employees who were promoted or granted financial upgradation under the Modified Assured Career Progression (MACP) Scheme between 01.01.2016 and 01.07.2016, who opted under Rule 5 of the CCS (RP) Rules, 2016, are eligible to exercise the option under the statutory proviso to FR 22(i)(a)(1) for regulation of their pay and to switch over to the $7^{th}$ CPC Pay Matrix from the date of their next increment, i.e., 01.07.2016;

c) and; if not, the reasons therefor?

(a): Pay fixation on promotion/financial upgradation of Central Government employees on or after 1st day of January, 2016 is governed by Central Civil Services (Revised Pay) Rules, 2016 and Fundamental Rules (FRs).

(b) & (c): Such cases are examined under the provisions of Rule 5 of the CCS(RP) Rules, 2016 and Department of Personnel & Training’s O.M. dated 27.07.2017.

2590. श्री श्रीभरत मतुकुमिल्लीः
क्या वित्त मंत्री यह बताने की कृपा करेंगे किः

(क) क्या केन्द्र सरकार के कर्मचारियों की पदोन्नति/वित्तीय उन्नयन पर वेतन निर्धारण सांविधिक नियमों अर्थात् केन्द्रीय सिविल सेवा (संशोधित वेतन) नियमावली, 2016 और मूल नियम 22(i) (क) (1) द्वारा शासित होता है;

(ख) यदि हां, तो क्या जिन कर्मचारियों को दिनांक 01.01.2016 और 01.07.2016 के बीच संशोधित सुनिश्चित कैरियर प्रोन्नति (एमएसीपी) योजना के अंतर्गत पदोन्नत किया गया था या वित्तीय उन्नयन प्रदान किया गया था, और जिन्होंने केन्द्रीय सिविल सेवा (संशोधित वेतन) नियमावली, 2016 के नियम 5 के अंतर्गत विकल्प चुना था, वे अपने वेतन के विनियमन के लिए एफआर 22(i) (क) (1) के सांविधिक परंतुक के अंतर्गत विकल्प का प्रयोग करने और अपनी अगली वेतन वृद्धि की तिथि अर्थात् दिनांक 01.07.2016 से 7वें केन्द्रीय वेतन आयोग वेतन मैट्रिक्स में बदलने के लिए पात्र हैं;

(ग) और यदि नहीं, तो इसके क्या कारण हैं?

(क): 1 जनवरी, 2016 को या उसके उपरांत केंद्र सरकार के कर्मचारियों की पदोन्नति/वित्तीय उन्नयन पर वेतन निर्धारण केंद्रीय सिविल सेवा (संशोधित वेतन) नियमावली, 2016 और मूल नियमों (एफआर) द्वारा शासित होता है।

(ख) और (ग): ऐसे मामलों की जांच केंद्रीय सिविल सेवा (संशोधित वेतन) नियमावली, 2016 के नियम 5 और कार्मिक एवं प्रशिक्षण विभाग के दिनांक 27.07.2017 के कार्यालय ज्ञापन के प्रावधानों के अंतर्गत की जाती है।
