Sub: Clarification regarding registration and updation of ‘Administrative Action’ cases in IRVINS
Ref: Railway Board’s letter of even no. dated 13.08.2021
It has been observed that instructions issued vide Board’s letter under reference and provisions contained in Para 521.2(i) of IRVM are being interpreted incorrectly by few Zonal Vigilance units, leading to inconsistencies in registration and updation of ‘administrative action’ cases in IRVINS.
The matter has been examined, and the following clarification is issued for strict compliance:
(i) Cases devoid of prima facie vigilance angle:
Cases where SDGM/CVO has found prima facie no vigilance angle are dealt as per Para 521.2(1) of IRVM and such cases may be sent to PHOD for taking administrative action on the administrative lapses found in the Preliminary Investigation Report. However, since there is no vigilance angle, so no entry is to be made in IRVINS against the officer.
(ii) Cases with prima facie vigilance angle:
In the cases where prima facie vigilance angle has been established as per Para 521.2(11) or Para 521.2(iii) of IRVM, case shall be registered against the officer in IRVINS as per Para 521.1 of IRVM. It is possible that subsequently, no vigilance angle is found against the officer after detailed investigation and ‘no action’ or ‘administrative action’ is recommended by SDGM/CVO. However, once a case is registered against a Gr. B or Gr. A officer, such cases cannot be closed at Zonal Level and so, all such cases are to be submitted to Railway Board for final decision. The final decision taken at RB level or CVC level shall be reflected in IRVINS.
This has the approval of PED (Vigilance) and CVO/Ministry of Railways.
