MINISTRY OF DEFENCE

New Delhi, the 11th December, 2020

S.R.O. 17.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of (i) the Indian Navy Civilian Technical Officers (Group ‘A’ Posts) Recruitment Rules, 2003; and (ii) Indian Navy Civilian Technical Officers (Group ‘A’ and ‘B’ posts) Recruitment Rules, 2003, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Chief Technical Officer, Senior Technical Officer, Technical Officer, Junior Technical Officer and Technical Assistant in the Indian Navy, Ministry of Defence, namely :-

1. Short title and commencement.- (1) These rules may be called the Ministry of Defence, Indian Navy Civilian, Chief Technical Officer, Senior Technical Officer, Technical Officer, Junior Technical Officer and Technical Assistant (Group ‘A’ and ‘B’ Posts) Recruitment Rules, 2020.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.– These rules shall apply to posts specified in column (1) of the Schedule annexed to these rules.

3. Number of posts, Classification and Level in pay matrix.- The number of the said posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age-limit, other qualifications, etc.- The method of recruitment to the said posts, age- limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualification.- No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.- Where the central Government is of the opinion that it is necessary or expedient, so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class to category of persons.

7. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Age-limit for direct recruits. Educational and other qualifications required for direct recruits. Whether age and educational qualification prescribed for direct recruits will apply in the case of promotees.

Period of probation, if any.

Method of recruitment whether by direct recruitment or by promotion or by deputation / absorption and percentage of the vacancies to be filled by various methods. In case of recruitment by promotion or deputation/ absorption, grades from which promotion or deputation/ absorption to be made.

Two years for re- employed Armed Forces Personnel. Promotion failing which by deputation (including short term contract). For Ex-servicemen : Deputation or re-employment. Promotion :

Senior Technical Officer in level-12 in the pay matrix (Rs.78800-209200) with five years regular service in the grade and having successfully completed two to four weeks of training in Technical or Managerial Skills from a recognised institute.

Note : Where  juniors who have completed their qualifying or eligibility service are being considered for promotion,  their  seniors  would  also  be  considered

provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service, or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service.

Deputation (including short term contract):

Officers under the Central Government or States Government or Union territories or public sector undertakings or recognised Universities or research institutions or statutory or autonomous organisations:

(a) (i)  holding analogous posts on regular basis in the parent cadre or department; or

(ii) with five years service in the grade rendered after appointment thereto on regular basis in level-12 in the pay matrix (Rs.78800-209200) or level-12A in the pay matrix or equivalent in the parent cadre or department; and

(b) possessing the following educational qualifications and experience :

(i) Bachelors degree in Mechanical or Electrical or Electronics and Communication or Marine or Naval Architecture or Industrial Engineering from a recognised University or institute;

(ii)    Ten years working experience in relevant field of engineering   out   of   which   at   least   three   years experience  in  Dockyard  or  Shipyard  in  Production, Planning, Control and Refit of Ships or Vessels.

Desirable:

(i) Masters degree in Mechanical or Electrical or Telecommunication or Marine or Naval Architecture or Industrial Engineering from a recognised University or institute.

(ii)    Two years experience of General Administration.

Deputation or re-employment (for Ex-servicemen):

The Armed Forces Personnel of the rank of Commander (IN) and above or equivalent due to retire or who are to be transferred to reserve within a period of one year and having the requisite qualifications and experience prescribed for deputation (including short term contract) shall also be considered. Such persons would be given deputation terms up to the date on which they are due for release from the Armed Forces; thereafter they may be continued on re-employment.

Note1: The departmental officers in the feeder category who are in direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

Note2: Period of deputation (including short term contract) including period of deputation (including short term contract) in another Ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not to exceed five years.

Note3: The maximum age-limit for appointment by deputation (including short term contract) shall be not exceeding fifty-six years as on the closing date of receipt of applications.
If a Departmental Promotion Committee exists, what is its composition. Circumstances in which Union Public Service Commission is to be consulted in making recruitment.

Group ‘A’ Departmental Promotion Committee (for considering promotion) consisting of:-

1.      Chairman or Member, Union Public Service Commission – Chairman;

2.      Joint Secretary (Navy), –  Member; Ministry of Defence

3.      Principal Director of Civilian Personnel, –   Member. Integrated Headquarters, Ministry of Defence (Navy)

Group ‘A’ Departmental Confirmation Committee (for considering confirmation) consisting of:-

1.      Joint Secretary (Navy),  –  Chairman; Ministry of Defence

2.      Assistant Chief of Personnel,  –   Member; Integrated Headquarters, Ministry of Defence (Navy)

3.      Principal Director of Civilian Personnel, –   Member. Integrated Headquarters, Ministry of Defence (Navy)

Consultation with Union Public Service Commission is necessary while appointing an officer on deputation (including short term contract) and for Re-employment.

    यदि कोई डिफेंस सिविलियन कर्मचारी नियुक्त होने से ३–४ साल के बाद कोई कारण से उसने ट्रांसफर की मांग की होगी और उसका ट्रांसफर एक ही कमांड में दूसरी यूनिट में समान पोस्ट और श्रेणी में बिना डिमोशन की ट्रांसफर हुई हो। लेकिन उसका रिस्ट्रक्टिंग प्रमोशन में बैक डेट्स से प्रमोट किया होगा तो,,कृपया बताएं की उस कर्मचारी की पदोनिती दी जाना चाहिए और क्या उसकी सीनियरिटी पर क्या असर होगा।
