Sub: Compliance of provisions of Para 525.4 of IRVM while submitting cases to Railway Board for First Stage Advice (FSA)
It has been observed during recent scrutiny of Investigation Reports forwarded to Railway Board for First Stage Advice (FSA) that the mandatory elements prescribed in Para 525.4 of IRVM are not being fully complied within the final comments of General Managers. Para 525.4 stipulates that before forwarding a case to Railway Board for FSA, the General Manager will recommend:
(i) quantum of responsibility of each officer/official,
(ii) the gravity of the various acts of omission or commission and whether these deserve formal disciplinary action (major penalty or minor penalty) or the ends of justice would be met by suitable administrative action or whether he proposed no action or transfer of the official out of the Division/Railway
(iii) The existence or otherwise of a “Vigilance Angle” in the matter.
(iv) Handing over the case to other agencies like the CBI etc., wherever necessary with full justification.
(v) In cases where the role of firms is also involved, whether he proposes any action against the firm like delisting, suspension, banning etc.
2. It is advised that, while summing up investigations and submitting the case to the General Manager by SDGM in terms of Para 525.2 of IRVM, these specific requirements of Para. 525.4 must be clearly brought to the notice of the General Manager, so that the final reference to Railway Board is complete in all respects.
3. This has the approval of PED (Vigilance) and CVO/Ministry of Railways.
