Sub: Clarification on fixation of pay of Running Staff posted to a Head Office stationary post on tenure basis.

With reference to the above, North Western Railway has sought clarification as to whether 30% pay element is to be taken into account while fixing the pay of a Running Staff member posted to a Head Office stationary post on tenure basis.

2. The matter has been examined in the light of existing policy provisions. It is observed that the wording of para 924(i)(d) has a wide connotation. Policy provisions or administrative instructions cannot be framed to foresee or cater to every possible factual situation that may arise in their application. The language of such provisions has to be understood in a reasonable and purposive manner, consistent with the overall object and intent of the policy. Accordingly, this wide connotation has been specifically restricted vide Board’s letters dated 15.09.2006 (RBE No.132/2006) and 20.02.2023 (RBE No.34/2023). Therefore, the view taken by the Railway in not allowing 30% pay element in such cases is found to be in order.
