SCs CREAMY LAYER EXCLUSION FROM RESERVATION
279. SHRI A. RAJA:
Will the Minister of SOCIAL JUSTICE AND EMPOWERMENT
(a) whether the Government is planning for Scheduled Castes creamy layer exclusion from reservation;
(b) if so, the details thereof and the reasons therefor;
(c) whether the Government has urged the Supreme Court to review its decision given last year in this regard; and
(d) if so, the details thereof and the reasons therefor?
ANSWER

(SHRI RATTAN LAL KATARIA)
(a) to (d): As per Department of Personnel and Training (DoPT), Samta Andolan Samiti has filed a Writ Petition No.2/2018 against the UOI before the Hon”ble Supreme Court praying for exclusion of creamy layer in SC/ST from the benefits of reservation. The Government has filed a reply against the above mentioned Writ Petition and the matter is presently sub-judiced.
